Yesterday, the Bombay High Court refused to postpone this month’s exam stating that any ruling may have a cascading effect on future examinations & that the court should not intervene even if ‘an education policy is bad’.

A bench comprising Chief Justice SV & Justice Sandeep V Marne ruled on a petition filed by activist Anubha Srivastava against the National Testing Agency (NTA). The petitioner had urged NTA to shift the January Exam & remove the 75% Eligibility Criteria.

She claimed that 12th Class students will be participating in their practical exams & vivas in January. It will lead to a clash between the board examination & JEE Main 2023 Examination Session 1. Even the CBSE HSC & ICSE 12th Board Examinations are scheduled to begin on 1st February. It will become difficult for the Class 12th students.

Meanwhile, the JEE Main 2023 Application Process is ongoing for the Session 1 Examination. Also, the JEE Main 2023 Exam Dates for Session 1 & Session 2 are announced.

While applying for the same process, candidates must need to ensure their JEE Main 2023 Eligibility.

However, the bench has decided against postponing the JEE Main 2023 Exam. “If any orders are passed for the postponement, it may have a cascading effect on future exams also. The extraordinary circumstances do not exist from holding the January Examination. Lakhs of students must have been preparing for the Exam.”

The court also added that there is a judgement in SC which states that even if a policy is not good, the Court cannot intervene. “Your PIL may harm 50,000 students but not affect 5 lakh students. A Supreme Court judgement says that even if an educational policy is bad, the Court will not intervene. In educational matters, judicial review is specific” the bench stated.

As per the official NTA calendar, the Session 1 Exam will be held from 24th to 31st January, 2023.

The petitioner requested that if the exam cannot be postponed, then an extra attempt should be considered in May 2023. “For this, the bench has asked us to file an interim application & then the request will be handled accordingly.” She added that “the students are not happy with this decision, but the bench has taken our point. But, due to some rules & policies, they cannot intervene in this.”

Anubha has also requested the NTA to remove the 75% eligibility criteria. The marks scored by the students is not a true reflection of their capability, therefore, those with fewer marks can score very high in the upcoming Exam.
